Definition of Waste: Development Industry Code of Practice

Image CL:AIRE launched its Definition of Waste: Development Industry Code of Practice on Thursday 11th September at National Grid offices in London. The event was attended by a cross section of the development industry including remediation specialists, contractors, consultants and policy makers.

The Code of Practice (CoP) provides clear and concise process to determine if excavated materials on a development site are waste in the first place and identifies the point when treated waste is no longer considered to be a waste.

In implementing the CoP, it is anticipated that there will be a reduction in the amount of excavated waste sent to landfill sites and in the quantity of natural raw materials used at development sites contributing to a more sustainable future.

Jane Garrett (Chief Executive Officer of CL:AIRE) stated:

“The CoP represents over 12 months of detailed negotiation and consultation resulting in a document that will provide far greater certainty in a very complex field. If it was simple, something similar would have been produced many years ago.”

She went on to say:

“CL:AIRE is extremely pleased to have been involved in a process that will make life much more easier in bringing land back in to beneficial use. We are rolling out specific training relating to the CoP, which will be of particular interest to those involved with land development projects. However, we must not stop here, in the future we will become the accreditation body for the “Qualified Person” who is central to the CoP and will continue to work with industry and the Environment Agency to measure the success of the CoP with a view to extending its scope to fixed Soil Treatment Facilities.”

Clare McCallan, Environment Agency Waste Policy Manager, said:

"This Code of Practice continues the drive to deliver good waste management practice in the development industry. It's the next step on from, and replaces, the Definition of Waste: Developing greenfield and brownfield sites' guidance that was published in April 2006."

"It's our joint aim that waste regulation ensures the environment and people are protected and complying with this new best practice will allow industry to take more informed decisions."

The Environment Agency has issued a position statement: 'Definition of Waste: development industry code of practice' at www.environment-agency.gov.uk which provides further links to advice about what the changes mean for you.
