Introduction & Context

The Definition of Waste: Development Industry Code of Practice is a voluntary Code (or CoP) launched in September 2008 to provide a pragmatic solution to using excavated materials, including soils on development sites in a sustainable manner without getting tangled up in waste legislation.

The CoP is applicable to England and Wales, initiated to provide a clear and concise process to determine whether excavated materials on a development site constitute waste in the first instance, and to identify the point when treated waste can no longer be considered as waste.

The CoP has been well received by those involved in the management of excavated materials and its reuse at specified development sites. Development sites are defined broadly, and include redevelopment of land, remediation and regrading activities.

Scope

Currently the CoP relates to:

  • Reuse of excavated materials on the site of origin; and
  • Reuse on development sites within a defined CLUSTER project.

The stand alone document “Fixed Soil Treatment Facilities” describes how they might fit within the CoP in future.
Important Note: it does not form part of the published CoP, at this time.

In order to expand the future scope of the CoP and take it to the next level, we need to gather evidence demonstrating the benefits that have accrued from practitioners using, or intending to use, the CoP. A ‘Register of Environmental Benefits’ has therefore been set up to capture your documented use or intended use and we would encourage practitioners to adopt the use of this register which is available on Page 3.

Application

The CoP (The Definition of Waste: Development Industry Code of Practice) must be read in conjunction with the Environment Agency Regulatory Position Statement and its Frequently Asked Questions. Information relating to the concept of the Qualified Person is described in Page 2.
